Overview

Welcome to PrayerTone, operated by KDMT GLOBAL LLC. By accessing our website, using our AI-generated audio services, or purchasing our products, you agree to be bound by the following strictly enforced Terms of Service. These Terms constitute a legally binding agreement between you (“User” or “Customer”) and KDMT GLOBAL LLC d/b/a PrayerTone (“Company,” “we,” “us”). If you do not agree to every provision of these Terms, you may not access or use our Services.

Section 1 – Nature of Service & AI Disclaimer

  1. AI-Based Creatives: You strictly acknowledge and agree that all creatives delivered by PrayerTone—including but not limited to vocals, lyrics, musical composition, and visual artwork—are generated by Artificial Intelligence (AI). These are not human-recorded performances.
  2. Subjective Quality & Artifacts: As AI-generated content, the deliverables may include non-standard phrasing, digital artifacts, occasional pronunciation variances, or “hallucinations” typical of current AI technology. These characteristics are inherent to the medium and are not considered defects.
  3. “As Is” Policy: We expressly do not warrant that the quality, style, emotional impact, or musical composition will meet your specific personal expectations or align perfectly with samples shown on our website.
  4. No Guarantee: The final output is generated based on your inputs but is ultimately determined by our algorithms. Dissatisfaction with the artistic or technical interpretation of the AI is not grounds for a dispute or refund.

Section 2 – Orders & Immediate Finality

  1. Non-Cancellable: Unlike standard e-commerce goods, our services are custom-generated digital products. Your order is final, binding, and non-cancellable immediately upon submission of payment.
  2. No Refunds: We maintain a strict NO REFUNDS, NO RETURNS, and NO EXCHANGES policy. By placing an order, you waive any right to cancel based on “change of mind” or dissatisfaction with the creative result.
  3. Right to Refuse: We reserve the right to refuse service to anyone for any reason. If we decline your order before work begins, a full refund will be issued.

Section 3 – Intellectual Property & Usage Rights

  1. Company Ownership: PrayerTone retains 100% ownership of all underlying code, models, audio recordings, visual designs, and the final digital products delivered to you.
  2. Limited Personal License: Upon full payment, we grant you a limited, revocable, non-exclusive, non-transferable license to use the delivered media solely for personal, private listening/viewing.
  3. Prohibited Commercial Use: You may NOT:
    • Upload the content to streaming platforms (e.g., Spotify, Apple Music, YouTube).
    • Broadcast, resell, or sub-license the content.
    • Use the content for any commercial purpose without a separate written commercial license from us.
  4. AI Training Rights: By submitting text, prompts, or other data to us, you grant PrayerTone a perpetual, worldwide, royalty-free license to use such data to train, tune, and improve our proprietary AI models and algorithms.

Section 4 – Delivery & Risk of Loss

  1. Delivery Defined: Delivery is deemed fully complete and successful the moment we transmit the access link or file to the email address provided at checkout.
  2. User Responsibility: We are not responsible for bounced emails, spam filters, incorrect email addresses provided by you, or your inability to download the file.
  3. No Storage: We do not provide permanent cloud storage. Download links may expire. You are solely responsible for downloading and backing up your purchase immediately.

Section 5 – Prohibited Uses & Termination

You agree not to use our Services to:

  1. Generate content that is unlawful, defamatory, or infringes on third-party rights.
  2. Reverse-engineer, scrape, or attempt to derive the source code of our AI tools.
  3. Initiate fraudulent payment disputes.

Violation of these terms will result in immediate account termination and a permanent ban without refund.

Section 6 – Payment Disputes & Chargebacks

You agree that initiating a chargeback with your credit card issuer for a product that was delivered in accordance with these Terms (regardless of your personal satisfaction) constitutes a breach of this agreement and potential fraud. You agree to reimburse PrayerTone for all costs, including legal fees and dispute fees, incurred in defending against such chargebacks.

Section 7 – Limitation of Liability

To the fullest extent permitted by law, PrayerTone shall not be liable for any indirect, incidental, special, or consequential damages, including lost profits or data. Our total liability to you for any claim arising out of these terms or the service shall be strictly limited to the amount you actually paid for the specific order giving rise to the claim.

Section 8 – Governing Law & Arbitration

Any dispute arising from these Terms shall be resolved exclusively by binding individual arbitration. You expressly waive your right to a trial by jury and your right to participate in any class action lawsuit.
